非存在者が「生まれない権利」を持つ、という考え方がありますが、私はこれを根拠にantinatalismを唱えることには反対する立場をとります。
非存在者は存在しないので、権利を持つことはできません。
生まれない（＝非存在のままでいる）権利というものを想定することはできても、それを持てる主体はどこにもいません。
この権利が持たれるためにはそれを持つ主体が非存在者でなければなりませんが、非存在者である権利主体というのはまさに文字通り存在しないので、権利を持ってそれを行使することができないからです。
実際のところ、ANを擁護するために「生まれない権利」という新しい概念を作る必要はないと思います。
以下にその理由を説明します。
存在する全ての意識は、他の意識に過大な苦痛をもたらさない限りにおいて自身の苦痛最小化と快楽最大化を追求する道徳的権利を持ちます。
表現の自由、裁判を受ける権利、アニマルライツなどと呼ばれる様々な種類の “権利” は、この最も基本的な権利（基本的意識権、とでも呼べばいいでしょうか）が現実世界で保障されるようにするための実用的な道具として言語化され、使いやすくなったものです。
生殖という行為は、この基本的意識権を持つ意識を作ることによって各種の権利が侵害される可能性を作ること――すなわち未必の故意、もしくは単なる過失による権利侵害です。
ヒトを作ればそのヒトの持つ職業選択の自由が侵害されることの容認を、ブタを作ればブタの持つ殴られない権利が侵害されることの容認を意味します。
「生まれない権利」という概念を作るまでもなく、生殖するべきでない理由を未必の故意／過失によるあらゆる種類の権利の侵害として説明できてしまうのです。
生まれない権利という概念は新しいものなので、生殖肯定論者が「そんな出鱈目は受け入れられない」と決めてしまえば説得力を失います。
しかし、「人権」「アニマルライツ」という概念を有効なものとして受け入れている生殖肯定論者であれば、ヒトや動物を作ることが未必の故意／過失による人権侵害／アニマルライツ侵害であることを否定することはできません。
Some antinatalists claim that the unborn "have the right not to be born".
I am opposed to basing antinatalism on it.
The unborn do not exist, therefore they cannot have any right.
We can of course claim that there is such a right not to be born (or, in other words, the right to remain non-existent), but there is literally no one who can have it.
This right requires the right holder to be non-existent, whlie a right holder who is non-existent cannot be there to have or exercise any right including this one.
In fact, I don't think we need this new idea of 'right not to be born' to argue for antinatalism.
Here's why.
Every single consciousness that exists has the moral right to try to minimize pain and maximize pleasure they experience only when it doesn't cause excessive amount of pain for others.
Those various 'rights' that we accept such as freedom of expression, right to a fair trial or animal rights are practical, easy-to-use tools created by putting actual ways to protect this basic right (shall we call this 'basic consciousness right') into words.
Procreating means creating consciousness that has this basic right, which then means creating possibilities of those various rights being violated; in short, procreation is violation of human/animal rights by willful/non-willful negligence.
For instance, when you create a human, you accept the possibility of their constitutional right to choose their occupation being violated (even though you are not the one to have this right violated), and when you create a pig, you accept the possibility of their right not to be hit violated (even though, again, you are not the one to suffer this violation... how selfish!).
We don't need the idea of the right not to be born which only non-existence can have; we already have these legal or moral rights violated by negligence as a means to show why we cannot allow procreation.
The idea of the right not to be born is so new that, once pro-natalists decide it's bullcrap, it is no longer persuasive at all.
However, the majority of those pro-natalists have probably accepted the idea of human/animal rights, which means they cannot deny the fact that creating sentient beings is a way of violating human/animal rights by negligence.
